HOLD/CHALLENGE
Policies
& Procedures for Commercial Customers
At The Louisville Palace Theatre, we will make every
effort to provide you with the specific dates you need to make your event
a success. In cases where two customers wish to book the same date, the
following policies & procedures governing how we will "hold"
dates and "challenge" dates
that have been previously placed on hold- will apply. We hope that these
are clear and self-explanatory. If you have any questions, or if we can
clarify these policies in any way, please contact the General Manager,

Placing
a "Hold" on a Date
We
will place a "hold" on any
date you request provided that there is not already a lease agreement
signed with another customer for that date. If you are the first to have
requested a hold for that specific date, you will have the "first
hold" on the date. In effect, this gives you the first
right of refusal so that we will not sell the date to another individual
or company without first giving you the opportunity to execute a lease
agreement & lock in the date (provided all of the other conditions
listed below have been met).
If a "first hold" has already
been placed on a date in which you are interested, we will be glad to
place a "second hold" on the
date. This gives you the option to execute a lease should the individual
or company with the "first hold"
not finalize arrangements for the date.
"Hold"
Policies
"Holds"
may be placed on any date for which a lease has not been executed.
We will "hold" your date until
the earlier of: (1) 90 calendar days following the date the hold was first
placed, or (2) 30 calendar days prior to the event, whichever comes first.
At that time, or if the "hold"
is placed less than 30 calendar days prior to the event, you will be required
to execute a lease agreement for your date & provide payment for all
deposits and/or fees due under the lease agreement. Which payment option
will be utilized will be at the discretion of the theatre. Should you
not wish for us to continue holding the date, or should the lease agreement
& financial arrangement requirements not be met within the time limits
specified, we will release your date & make it available to any "second
holds" or other interested parties.
"Challenging"
a Held Date
Should you wish to secure the use of a date which is being held by another
individual or company, the following procedures for "challenging"
a held date will apply:
Notify the theatre that
you wish to "challenge" the
person or company holding the date in which you are interested.
The theatre will prepare
a lease agreement for your signature & inform you of the total due
under the terms of the lease.
Upon receipt of both
the signed lease & all deposits & fees due, we will inform the
individual or company holding the date that they have 24 hours in which
to secure the date through execution of a lease & payment of deposits
& fees.
Should the person or
company release the date, or not execute a lease & provide payment
within 24 hours, the date will be yours (under the provisions of the executed
lease). Should the other party secure the date, we will refund your deposit,
etc..
We hope that this clarifies the terms under which we will "hold"
or "challenge" an event date.
